The EPCNT is a Purchasing Cooperative organized under Chapter 271.101 of the Texas Local Government Code and Carrollton-Farmers Branch ISD is the fiscal agent for this cooperative. It is made up of equal members whose entities reside within the geographical boundaries of Regions 10 and Region 11 as defined by the Texas Education Agency, have executed the necessary Interlocal Agreement and are current with annual dues of $100.00 per entity. While EPCNT is a Purchasing Cooperative, there is no agency that functions as the administrator for this cooperative. Instead, EPCNT is a contract sharing cooperative and not an administrative cooperative.
Each eligible contract used under the EPCNT umbrella is issued and awarded by one of its members. Inclusive language accepted and agreed to by each awarded vendor is what allows contracts to be shared within the legal bounds of this purchasing cooperative. EDGAR compliance is a component of each individual purchase contract and not with the EPCNT Purchasing Cooperative itself, since there is no administrative board, body or agency that operates the EPCNT.
If a member entity is procuring goods or services through a contract awarded by an EPCNT member entity using federal funds, there may be additional requirements under federal law. These requirements may include, but are not limited to, the procurement standards of the Uniform Administrative Requirements, Cost Principles and Audit Requirements for Federal Awards, 2 CFR 200 (sometimes referred to as the “Uniform Guidance” or, when related to federal grants administered by the U.S. Department of Education, the “new EDGAR”), procurement standards issued by the United State Department of Agriculture and the Texas State Department of Agriculture for purchases under the National School Lunch Program, School Breakfast Program, Summer Food Service Program, Special Milk Program and Child and Adult Care Food Program.
For verification of EDGAR compliance for any contract awarded as an EPCNT contract, it will be necessary to obtain that from the awarding entity. While EPCNT makes every effort to assure all member entities observe all requirements of the cooperative, provides training on needed procurement matters and provides information pertinent the procurement process for government entities that fall under the rules and regulations required of public school districts in the state of Texas, neither EPCNT, nor Carrollton-Farmers Branch ISD as its fiscal agent, is responsible for the assurance of EDGAR compliance for any contract awarded or utilized by any of its member entities.
Carrollton-Farmers Branch ISD, as the fiscal agent for EPCNT, is issuing this notice on behalf of the EPCNT Purchasing Cooperative. It is the responsibility of the entity utilizing any contract identified as EPCNT compliant to assure itself that all procurement laws for any purchase have been met, including Texas Education Code §44.031, 2 CFR Part 200 and other applicable law.
